The tagline for the NMSF is “Protecting, Preserving, & Promoting America's Underwater Treasures”. They are a non-profit NGO with a million dollar budget and they specialize in the acquisition and restoration of private property. The NMSF will do to the ocean what the USFWS has done to our public lands and none of it is good. Oregon: Transfer public lands from feds?Sunday, October 13. 2013 by Sen. Doug Whitsett The United States government owns more than 55 percent of all the acreage in Oregon. A total of more than 53,000 square miles, or 34 million acres, is held in federal title. Oregon has the fifth highest federal ownership percentage among all of the 13 Western states. So what is wrong with this massive federal ownership of Oregon land and how did it happen? The United States Constitution prohibits the states from imposing or collecting taxes on property owned by the federal government. More than half of the landmass of the state of Oregon is thereby excluded from Oregon’s taxing authority. Any existing or potential improvements located on that 53,000 square miles of federal land is also exempt from property taxation. This situation obviously creates a huge barrier to the adequate funding for Oregon’s schools, public safety, transportation infrastructure, and care for our most vulnerable citizens. Further, the federal ownership of more than half of the landmass of Oregon functionally excludes it from economic development. Virtually all of Oregon’s businesses, jobs, wealth and infrastructure are found on the 40 percent of Oregon’s landmass that is privately owned. Conversely, virtually none is found on the 34 million acres of federally owned land. Coos Bay City Council Rejects Promise of Federalism and Oath
Under Article VI cl. 3 all officers of the state and central government (located in Washington D.C.) must take an oath to support the Constitution. This oath makes state, local and central government officers "federal officers" whose duty it is to protect, defend, support and preserve the Constitution. This is part of the vertical and horizontal checks and balances of our federalist system and all "federal officers" have a duty to protect the federal system.
From a different perspective we can say that all state and local governments are part of the federal system of government but the central government is not part of the state governmental systems which are independent and sovereign as to each other and the central government.
The states are sovereign and it is in large part their sovereignty that the Constitution, and the federal system within which it rests, seeks to protect. Such sovereignty is not protected simply for the sake of having sovereign states but because the Framers believed the maintenance of the states' sovereignty was essential to preserving the unalienable and fundamental God given rights of the citizens. Only as sovereign states could the states act as watchdogs over the central government.
President Kennedy said "The ignorance of one voter in a democracy impairs the security of all." This is even more true of our state and local "federal officers" who are either ignorant of our federalist systems and their duties to such or simply disregard their duty for other reasons such as laziness or actual distain for our principles of government.
When local "public servants" say actions and policies of the "federal government" are not
within their realm of authority or part of their job description or they should not waste time on such "federal" issues they are showing their incompetence to hold office. They are also violating their oath to support the Constitution. They are a clear and present danger to our federalist system and endanger the sovereignty of their state and the Liberty of every man woman and child in this federalist Republic.
What’s even worse are those who, after being informed of their duties by the citizenry, insist on their anti-federalist and un-American course of action. As Dr. Martin Luther King said: "“Nothing in the world is more dangerous than a sincere ignorance and conscientious stupidity.”
Once informed of their error, of their ignorance, those that insist on such course are either stupid or in defiance of the will of the people and the obligations of their office.
They must be targeted for removal at the earliest convenience of the citizens. And, until they can be removed the citizens should cover them with a blanket of contempt so that they will either mend their evil ways or beg leave of the situation.

On Thursday September 12th we held a work session with the city council. Two of which requested it themselves but we're not present. One (Dr. Muenchrath) was called into surgery, so he had an acceptable excuse. The other was councilor Daily. The only ones present were Oregon State PANDA Director Shane Ozbun, myself, the city manager, city attorney, police chief, and two city councilors; Melton and Groth. Four councilors and the mayor were not present.
The information, including an audio tape of the work session was provided the next day by the city manager to all who we're not present. No excuse was given for them not being there. There is absolutely no proof that those not present even read the material from the work session or listened to the audio tape, prior to the 17th when they unanimously voted it down. We were not allowed to ask any questions. Therefor, in my opinion that they failed to make a proper decision based on "feelings" instead of Constitutional facts.
On Tuesday the 17th, Rob Taylor with Coos Watchdog and myself were present during the City Council meeting where we were allowed only three minutes to present our position against the provisions in the NDAA dealing with American citizens and lawful resident aliens as unconstitutional. Also, we request they pass the Restoring Constitutional Governance Resolution (RCGR). The mayor refused to allow for open discussion, stating that "you've already had a work session on this."
We were not allowed open discussion and were angrily stifled by the mayor as she banged her gavel on the desk. At one point police chief Gary McCullough and a sergeant maneuvered behind staunch advocate Rob Taylor, preparing to either remove or arrest him, as he gave a passionate patriotic testimony, asking them to protect our liberties from the Federal government.
Councilor Daily made the motion to vote against it, after which it was seconded and voted down.
Several reasons were given. 1. That it' isn't within their authority to go against the Federal Government. 2. They just don't feel comfortable with it. 3. The Federal Government doesn't like it when we don't go along with them and this could cause problems for the city (paraphrased). 4. We don't want to tell our police not to do their job. 5. Let it take it's course through the courts to find it unconstitutional. 6. We don't have the authority to repeal Federal laws. 7. We can't determine if something is unconstitutional or not. 8. I just don't feel comfortable with this. 9. I just don't think it's part of our job as we we're elected to handle only city issues. Video included. Watch until you see us walk out.
Listen closely to the city attorney's concerns about passing the resolution and what could happen if they did. Even after we had proven that this does effect American citizens through documentation, a well done power point and congressional proof, including bills from several congressmen introducing a bill to repeal sections 1021 and 1022 that failed in the House. We showed them irrefutable proof how Senators Lindsey Graham, John McCain and Carl Levin pushed for it to include American citizens, calling America the battlefield.
Oath Keepers made it clear to the council that they are intentionally negligent in their Constitutional duties as to their oath of office under the U.S. and Oregon Constitutions. We showed them a list of venues across the country that have passed resolutions against the provisions in the NDAA; stating that out of all of these elected officials having passed resolutions, that they are all wrong and this council is right?

The USF&WS completed the first phase of the marsh expansion on the Ni-les’tun unit in 2011. The following is the agency’s own description of their efforts: “In September 2011, the Refuge completed marsh restoration for this unit. The influx of saltwater and freshwater will allow re-establishment of mudflats and marsh plants, and interconnecting tidal channels bisect the wildlife habitat south of the overlook deck. As the land returns to a rich functioning intertidal marsh, flocks of seasonally driven migratory birds and young fish will use the restored habitat.”
What the Service failed to mention in their report is that their work on this project would also spawn millions of mosquitos -- destroying residents’ quality of life, harming livelihoods and endangering the health of humans, animals, and wildlife. Many people, including biologists and health professionals, believe the explosion of mosquito larvae populations directly resulted from work done by the agency during the first phase of the marsh expansion. Some even believe the mosquito invasion may have been a deliberate tactic to turn current property owners into “willing sellers”, thereby eliminating the biggest barrier to marsh expansion.
It is hard to believe the Service could not have foreseen the mosquito problem. It is not new. In fact, efforts to fight mosquitoes in this area began more than a century ago.
The Swamp-Land Act of 1860 empowered the state of Oregon to dike marshes and drain swamps for mosquito abatement. In the early 1900s, The Army Corps of Engineers repaired tide gates on the Coquille River to prevent tidal waters from moving into the valley. Before the construction of these gates, the tide would rise into the valley, while the receding water pooled in stagnant ponds, creating perfect breeding grounds for mosquitos. Fear of mosquito-borne diseases, which include malaria, yellow fever, encephalitis and others, led the Corps and local interests to install the original tide gates. The Service should have known the history of the area before they removed the tide gates during the first phase of the project. With all the available, historical documentation and professional experience with other wetland restoration projects, one wonders if the agency’s conduct was a case of inexcusable ignorance or, even worse, willful malfeasance.
Recently, there has been a spate of news stories about Bandon’s mosquito problem. It has become such a serious issue that, on August 30, 2013, Senators Wyden and Merkley, and Congressman DeFazio wrote a letter to the new Secretary of Interior, Sally Jewel, demanding that The Department of Interior take immediate action to alleviate the problem. In the letter, the Congressmen put the blame for the “mosquito invasion”directly on the expansion of the marsh and at the feet of the US Fish & Wildlife Service.
In early August 2013, the Service issued a press release announcing that the Bandon Marsh expansion was “suspended” due to lack of funding. The suspension is a small victory for the opponents of the marsh expansion, proving that the people of Coos County can stop government action – in this case, a federal land grab -that harms our area when we set aside differences and work together.
This same, unified approach is needed to help people dealing with aggressive mosquitoes and caustic chemicals for vector control. This catastrophe was manmade and avoidable. Those responsible must be held accountable. The fight to rid the county of the agency’s unwanted actions must escalate or the residents of the region will have to tolerate swarming mosquitos and exposure to insecticides from aerial spraying for the foreseeable future. The only real remedy for this problem is a class-action lawsuit against The US Fish & Wildlife Service that uses the force of the courts to get the agency to replace the dikes and drain the marsh. The people who have suffered tangible loss should seek compensation through legal action.
In addition, the battle against government-created wetlands will have to expand to include projects such as the one in the China Creek, Winter Lake area. According to a seven-stage priority restoration map produced by The Nature Conservancy, The USF&WS and the Conservancy are making plans to acquire another 15,000 acres in the Coquille Valley, which was evident in the Conservancy’s application for a grant from the Oregon Watershed Enhancement Board. If they execute the plan properly, the Bandon Marsh expansion area will connect to the Oregon Department of Fish & Wildlife’s Winter Lake Restoration Project. At that point, the entire valley would become one large mosquito farm.

From the article I read in your local paper it appears that the public has been given some misinformation about the effective use of mosquito repellents as well as the safety of modern mosquito control products to both them and the environment.

Last week, I attended the meeting at the Barn. I am so sick that you allowed supposed "experts" to lie to us. After the vector control expert told us that lobsters in Maine are better than ever...I checked. Yes they are
better...because they OUTLAWED that chemical. They were the only state that lobsters got better and the only state the chemical was outlawed. Now other states have started outlawing the chemical.

Thank you for sharing your concern and giving us an opportunity to respond. A variety of questions have been raised about (S)-methoprene and crustaceans over the years. These were put to rest with completion of expected environmental concentration (EEC) studies in 1992 showing that time release (S)-methoprene products do not result in aquatic concentrations of (S)-methoprene which pose a risk to crustaceans. In the process of registering MetaLarv® S-PT, a similar EEC study was completed. Concentrations in the MetaLarv® S-PT study also fell below the threshold of risk.
Attached is a report from EPA on the methoprene re-registration process. Here are the report’s Regulatory
Conclusions:
• The studies available to EPA indicate that the biochemical insect growth regulator
Methoprene is of low toxicity and poses very little hazard to people and other non-target species.
• Ecological concerns contained in the 1991 Methoprene R.E.D. FACTS document related to toxicity to estuarine invertebrates have been alleviated as a result of submission of the estuarine invertebrate life cycle toxicity study in 1996, which indicated minimal chronic risk to Mysid Shrimp.
It may also be of benefit to you to know that Oregon Department of Environmental Quality, Oregon Fish and
Wildlife, U.S. Fish and Wildlife Service and Oregon Health Authority permitted or approved the product selection and application plan.
I hope that this information eases your concerns. I'd also like to add that USFWS is paying the full cost of the application.

Rebuttal:
The August 13th Op-ed piece put out by the World’s editorial board can only be characterize as a counter attack against the citizens’ effort to get the local governments to uphold their oath to the Constitution. Such was insulting, patronizing and transparent to all but the most naive in these matters and / or those desperately in need of praise and acceptance.
The editorial board’s advice to the local governing bodies on how to deal with citizens:”… listen attentively, then get back to the job it was elected to do. How UN-American. Ignore the citizens but do it politely and sugar coat it with praise. This is the fundamental reason we are losing the Republic and the personal Liberty for which it once stood i.e., indifference to the citizens.
The editorial board apparently thinks the citizens behind this movement are so inexperienced, so naive or so emotionally crippled they cannot understand the true nature of the board’s article. The board surrounded its real message in pseudo-praise of the citizens involved. Leading off with: “They are nothing if not passionate” the meaning of which became clear by the end of the article i.e., The World’s editorial board thinks we are naive zealots.
The article was not so much of a message as it was a demonstration of how to counter attack the efforts of the citizens. It encourages the local governments of Oregon to largely follow the path taken by the Coos County Commission: deny, delay, and deceive. The board even characterized the Coos County Commissions’ passage of a do nothing resolution, of its own design, as a “partial victory”. In fact it was and will remain a total loss for Liberty unless the citizens now take appropriate action to re-educate the Commission on their true responsibilities which includes being responsive to the will of the citizens. The Commission’s action was cowardly and deceptive.
The board apparently believes a key to success of this counter attack is to heap insincere and meaningless praise upon those leading the charge. Pat them on the head and tell them they are smart little boys and girls and that they really appreciate our patriotism and our “quintessentially American” activism.”
They are like the politicians in the middle of a new election cycle who pump out the words and phrases their researchers tell them the “tea party” people will responded to like: “conservative”, “original intent” , “fiscal conservative,” “self reliance” and “personal responsibility.”
The board’s comments that the citizens involved in this effort are ” well organized, educated on their position and motivated by patriotism…”, ” [t]heir presentations are thorough, their arguments persuasive…,” “the activism they’re practicing is quintessentially American — citizens actively engaged in the conduct of their government…”are insincere tripe and only meant to divert, delude, deceive and defeat the actions of “We the people.”
We do not need anyone to tell us we are good little patriots and how proud they are of us. We understand what the politicians’ oath of support means and what it requires of them and we understand when they are not up holding it. They do not need to be proud of us they need to fear us.
The editorial board’s article exposes it’s misunderstanding of or a disregard for the fundamental way this Republic is suppose to operate, where the citizens are the “kings” and the government is the servant. It is instead promoting a type of benign feudalism in which the government is sovereign and rules over its wards of the state, the citizens, in a patient and forgiving majesty.

It was a compromised victory
Thank you for calling and emailing the BOC and letting them know that the National Defense Authorization Act of 2012 is a very bad law for Americans. The Commissioners voted down the Restoring Constitutional Governance Resolution that Constitutional Attorney Richard Fry had drafted specifically to oppose the unconstitutional provisions of the NDAA 2012 and opted to vote on the resolution most acceptable to the Board.
The result was a stronger draft on the resolution drafted by Commissioner Main and Legal Counsel Josh Sober, but it still has a few problems with its final construct. Commissioner Sweet stood his ground and voted NO on both resolutions.
Unfortunately, the support for an initiative to put the RCG resolution on the ballot is waning due to the passage of the compromised resolution passed by the BOC. Therefore, I do not believe it would be wise to waste energy on an initiative when we can work to put most of the wording from the RCG resolution into the Coordination Plan that the County’s attorney is currently drafting. Enacting the Coordination Plan with this wording would make the resolution part of the law and not just a symbolic document.
There are other opportunities on the horizon. The Coos Bay City Council will be deciding if the city should enact the RCG Resolution and you can help by calling the City Councilors and ask them to support your rights by voting YES on the RCG Resolution against the unconstitutional provisions, sections 1021 & 1022 of the National Defense Authorization Act of 2012. You can contact the Coos Bay Councilors by calling or emailing the City Manager.

America’s perpetual War on Terror & War on Drugs has created an environment of constant government suspicion and surveillance of the people at an exponentially alarming rate. We must be vigilant against these types of laws.
1. It does not address the application of the "law of war" to citizens[1] anywhere including in the U.S., under whatever asserted authority,
2. It address only "indefinite military detention", but NDAA violates over half the Bill of Rights[2]and citizen
protections under Article III §3,
3. It does not find the subject NDAA provisions to be "unconstitutional" but only "opposes" the ""indefinite military detention" thereby tacitly approving the vast majority of violations of citizens' fundamental rights,
4. It does not direct employees and agents of the County not to assist in the violation of citizens’ rights and thereby leaves it up to the employees discretion as to whether they assist in such violations,
5. It does not direct employees and agents of the County to go to the aid of citizens whose fundamental rights are being violated under the NDAA or other related authority, thereby failing to provide leadership to their
subordinates,
6. By failing to provide a detailed account of the NDAA violation, they are failing to educate and motivate our fellow citizens and public officials about the serious constitutional violations and to act to protect the citizens' rights.
7. By substituting their deficient resolution for that proposed by the citizens, the Commissioners are attempting
to disregard the will of "We the People".
8. By proposing and supporting this resolution, the Commissioners are violating their oath to support the Constitution and are violating their duty to protect the fundamental rights of the citizens.

I have been traveling to Bandon every summer for over 15 years...I have never been eaten alive like I was this past week. It is awful. I had to leave early, dismiss many of the usual outdoor activities I have enjoyed in the past. I have 12 large welt bites still that are obnoxious...itching like crazy, ugly and of much discomfort. I am 60....we are afraid of West Nile at my age.....
I will not return until the problem is solved....Bandon Dunes golf course is handing out mosquito kits to golfers. OMG...for an area that has no industry but tourism, this mosquito invasion is a disaster.

I live over on Prosper rd. The Mosquitos are ridiculous. Something has to be done now. I hope it doesn't take a person to get deathly ill for something to be done. There is no doubt this is because of the marsh expansion. Why did we expand it in the first place. Who is the responsible party? They need to be held accountable. They have ruined Bandon, and they need to correct the problem now, or we will file a class action law suit to reverse
the expansion. This is serious matter. We will not let a marsh ruin our town. Enough is enough.
I am on Tom Smith Rd. off Prosper, past 2 months are absolutely outrageous with man eating monster mosquitos. They chase you, bite thru clothes, no spray works, no outside lite rids them, no bug spray, lawn spray we in this area have bought it all-----lots of $$$$. I have lived in this house 20 yrs., in Bandon all life, never ever seen this breed of mosquito. No problem until the unneeded marsh went in. Company has came and went from out of town, we could not even be outside---bites all over, Chase you in house, car is smeared with mosquitos.
If I can figure a way to bottle a bunch and bring to someone who thinks they are just a mosquito--and let them go--------------------------------!!!
Something needs to be done. They quit the aerial spray 3 yrs ago--------------------why?????
